Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Energy Policy Intel Pty Ltd (ACN 696 543 085) ("EPI", "we", "us", "our"), governing your access to and use of the Energy Policy Intelligence platform and related services at energypolicyintel.com ("Service").

By accessing or using the Service, subscribing to a plan, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Service.

These Terms apply to all users including waitlist registrants, trial users, and paying subscribers. Where you are accessing the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. The service

EPI provides an AI-powered regulatory and policy intelligence platform that monitors clean energy policy sources and delivers curated daily briefings to subscribers. The Service includes access to daily briefing emails, an online member portal, a briefings archive, and related features as developed from time to time.

The Service is designed to assist energy professionals in staying informed about policy developments, funding opportunities, and regulatory changes. It is an information service only.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to subscribers.

3. Subscriptions and billing

Access to the full Service requires a paid subscription. Subscription plans and pricing are displayed at energypolicyintel.com. Current plans include a monthly subscription and an annual subscription.

Subscriptions are billed in advance on a recurring basis (monthly or annually) through our payment processor, Lemon Squeezy. By subscribing, you authorise recurring charges to your payment method at the applicable subscription rate.

Founding member pricing is locked in for the life of your subscription, provided your subscription remains active and in good standing. Founding member pricing does not apply to subscriptions that lapse and are subsequently reactivated.

We reserve the right to change subscription pricing for new subscribers at any time. Existing subscribers will receive at least 30 days notice before any price change affects their subscription.

4. Cancellation and refunds

You may cancel your subscription at any time through your Lemon Squeezy account or by contacting us at hello@energypolicyintel.com.

For monthly subscriptions, cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date.

For annual subscriptions, cancellation takes effect at the end of the current annual period. We do not provide pro-rata refunds for unused portions of annual subscriptions, except where required by applicable consumer protection law.

We offer a full refund within 7 days of your initial subscription if you are not satisfied with the Service. To request a refund, contact hello@energypolicyintel.com within 7 days of your first payment.

Consumer Law may provide you with rights and remedies in addition to those set out in these Terms.

5. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

Share your account credentials or allow others to access the Service using your account.

Reproduce, distribute, resell, or commercially exploit briefing content without our written permission.

Systematically download, scrape, or extract content from the Service.

Use the Service to develop a competing product or service.

Attempt to gain unauthorised access to any part of the Service or its infrastructure.

Use the Service in any way that could damage, disable, overburden, or impair it.

Violation of these terms may result in immediate termination of your subscription without refund.

6. Intellectual property

All content generated by EPI including briefing summaries, analysis, platform design, and software is owned by Energy Policy Intel Pty Ltd and protected by copyright and other intellectual property laws.

Your subscription grants you a personal, non-exclusive, non-transferable licence to access and use briefing content for your own professional purposes. This licence does not permit redistribution, resale, or use in competing services.

Source content referenced in briefings remains the property of the original publishers. EPI summarises and analyses source content under fair use principles and does not reproduce source content verbatim.

You retain ownership of any content you submit to us, including feedback and suggestions. By submitting feedback, you grant us a royalty-free licence to use it to improve the Service.

7. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, EPI makes no warranties, express or implied, regarding the Service including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

EPI does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that briefing content is accurate, complete, or current.

Briefing content is produced using automated AI systems and may contain errors, omissions, or outdated information. You should independently verify any information before acting on it.

8. Not financial or legal advice

The Service provides general information and intelligence about energy policy and regulatory developments. It does not constitute financial advice, investment advice, legal advice, or any other form of professional advice.

EPI is not a licensed financial services provider. Nothing in our briefings should be relied upon as the basis for any investment, financial, legal, or business decision. You should seek independent professional advice before making any decision based on information contained in our briefings.

To the fullest extent permitted by law, EPI expressly disclaims all liability for any loss or damage arising from reliance on briefing content.

9. Limitation of liability

To the fullest extent permitted by applicable law, EPI's total liability to you for any claim arising from or related to the Service is limited to the amount you paid for the Service in the three months preceding the claim.

EPI is not liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, loss of data, loss of goodwill, or business interruption, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability under the Consumer Law for significant failures.

10. Indemnification

You agree to indemnify and hold harmless EPI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising from these Terms or the Service.

For subscribers outside Australia, mandatory consumer protection laws of your jurisdiction may also apply and are not affected by this clause.

We encourage resolution of disputes informally in the first instance. Contact us at hello@energypolicyintel.com and we will make reasonable efforts to resolve any issue promptly.

12. Changes to these terms

We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before the changes take effect. The current version of these Terms is always available at energypolicyintel.com/terms.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must cancel your subscription before the changes take effect.
